D.C. COURT $94,500 JUDGMENT AGAINST FAX.COM, INC. AND INJUNCTION
On December 8, 2004, the D.C. Superior Court issued a $94,500
judgment against Fax.com, a $85,500 judgment against officers Kevin Kaz and Eric
Wilson, and an injunction against all of them prohibiting future violations
of the TCPA in D.C.

APPEAL BRIEFS AND ORAL ARGUMENT IN FAX.COM CLASS ACTION
Petitioner Bruce Levitt, on behalf of a certified class of Maryland persons, has filed briefs arguing that private citizens may file suits in Maryland state courts, and the state may not choose to 'opt out' of the TCPA. The Briefs are posted in the Briefs section. Oral argument is Oct. 2, 2003 in Annapolis in the Maryland Court of Appeals for this case and two additional junk fax class actions that have all been consolidated for a hearing: R.A. Ponte Architects v. Investors' Alert, Inc., and Felland v. Digi-Tel Communications, LLC.

CALIFORNIA ATTORNEY GENERAL FILES ACCUSATION AGAINST CHARLES MARTIN!
The California AG is attempting to strip Charles Martin’s private investigator license. Martin is a Vice- President of Fax.com. A PDF copy of the accusation is here. A trial is expected in 2003. U.S. INTERVENES IN BALTIMORE CLASS ACTION AGAINST FAX.COM
The United States, on behalf of the FCC, has filed a motion to intervene in Levitt v. Fax.com, Case # 24-C-01-2218. The U.S. filed a brief to defend the constitutionality of the Telephone Consumer Protection Act. On November 27, 2002, all of Fax.com's arguments for dismissal on constitutional and other grounds were rejected and denied. See Levitt v. Fax.com. Plaintiff has filed a motion for injunctive relief to stop Fax.com from faxing unsolicited advertisements.
